Legal Question in Family Law in Texas

I filed for divorce for several reasons, one being adultry. Husband has had several girlfriends, though I have never cheated on my husband I did talk to someone in another state on phone text message. Question is my husbands atty is trying to get contents of text messages to claim I am the cheater and my husband should get custody of the kids. Is it possible for him to get the contents? If they are bad but there was no physical contact does this make any difference in custody of our children? I have heard a vast arrrange of answers 1)phone cos. do not keep texts past 72 hrs. 2)atty can get only in criminal cases 3)anything he can convince the judge is pertinent with a subpoena etc. Please help!

If you have an attorney, he or she should be answering these questions. If you don't, you need one! A contested custody case is not something for a do-it-yourselfer.
