What would it take to get text messages off my husbands phone? Would I have to have a court order in the State of Texas?

You could get the text message by a subpoena to the phone company (but that will only work if the phone company still has a copy of the text message).

A lawyer could help you in this process, including possible just getting your husband's phone for examination.
