Legal Question in Family Law in Texas

thief in the house

My parents have a 48 yr. son who has stolen from them before. He recently has stolen their ATM card and removed 3100 cash from their banking account. (He is a drug addict and has been for the past few years. He has also been to prison for coccain and theft charges.) They were not notified by the bank and he has shown back up to their house realizing he has been kicked out and disowned. He is still sitting in their backyard! What do we need to do? What about the bank issue too? Urgent please help!

Call the sheriff or the police and file charges against him for stealing $3100 that will get him out of the back yard and some time to chill out.

If your parents really want to put an end to this matter, they need to file criminal charges against him and be willing to stand in front of a Judge and testify that he stole from them.

Unfortunately, many parents don't want to do that.

I would urge you to encourage your parents to attend meetings of family members of drug addicts to learn how they are "enabling" his drug usage. I've seen it in many families -- this situation is not going to get better. Usually it does not end until the person od's.

I would also go to the bank and change accounts. Your parents need to file a theft charge and then see if the bank will refund their money.

There is a lot you can do but you have to be willing to handle criminal charges.

If he is out of control, they need to be willing to file a restraining order against him so that he cannot come around them or their home.
