Legal Question in Family Law in Texas

If I am thirteen years old and my dad is on probation for theft and my mom is clean, no probation no nothing, and i want to live with my dad do i have a right to choose the parent i live with even though both my parents want me living with them?

The ultimate decision is the court's. However, the court will consider your desires, since you are over 12, in determining what is in your best interests. However, the fact that your dad has a theft conviction and is still on probation will also be considered. In any event,assuming that there is court decree stating that you must live with mom, if you want to live with dad, dad will have to hire a lawyer to ask the court to modify its decree.
