Legal Question in Family Law in Texas
time limit to file notarized custody modifications
I signed an 'Order in Suit to Modify Parent-Child Relationship' in May of 2004. The signature was notarized, and I gave the original to my ex-husband which he said would be filed immediately. I have since learned that the modification was never filed. I no longer agree to the terms of the modification. Can the modification still be filed? Do notarized court documents expire if not filed in court within a certain period of time?
Any help would be most appreciated!

Re: time limit to file notarized custody modifications
First, was there an active case on file at the courthouse? If so, I don't know if the case is still active. Many courts dismiss cases if they are over 12 months old.
I'd call the Harris County Family Law Intake line and see if the case is still pending.
Or you can call the actual court and see if it's pending.
The Harris County District Courts have their own website. It contains phone numbers of all the courts.
It might have DWOP'd - dismissed for want of proscution.
If so, you'd need to start all over again.
If it is active, you can change your mind and notify the court that you no longer agree to what you signed months ago.
