Legal Question in Family Law in Texas
Time limit on finalizing divorce
i am currently going thru a divorce. the only thing holding us up is him getting a refinance loan on our home. he turned down a loan because on a 67K loan, payout over 30yr would be over 200K. He either has to do this or we can let the judge order all marital assets sold. I am trying to push him to get this over with (it has been 10 months since I filed) and he is telling me that the statute in the state of Texas for divorce is 2 years - that it could drag out that long before we are forced to do anything, at which time he wont have the assets he has now, (he has been hiding things already but I cant prove it). Can I force things along or is it true it can sit there and do nothing for up to 2 years?

The answer in one word is NO!
It depends on the county you filed in. In Harris County, cases dismiss after less than one year. Fort Bend tends to take up to 2 years.
Of course, most judges will work with you and extend the trial date if there are reasons to postphone it.
I assume you have an attorney. If not, you really need to hire one!
