Legal Question in Family Law in Texas

First Time Mother

The father and I are no longer together. I have chosen to give the baby my last name, which the father is not happy. I was told if I did he would not sign the birth certificate. By law do I have to give my baby father's last name; even if I pursue child support? If father takes me to court will the judge make me change the last name?

Re: First Time Mother

You do not have to give your baby anybody's name, but if the father takes you to Court and paternity is established and he requests the child be given his name, the Court will probably order the child's name changed.
