Legal Question in Family Law in Texas

Tired of child support not being used for the child!

Husband and I pay $340/month to ex-wife in child support; she refuses to spend any of it on child. Freely admits it, spends it on herself and boyfriends, taunts child with this. She does this because she knows my stepdaughter tells us everything. Trying to goad us into taking child to live with us, but without giving custody because she wants to keep getting support. She is trying to make the situation so bad that we feel we have no other choice but to take child, even if it means continuing to pay child support to mother. Is playing this game with fathers of her two other children, child support simply a career for her. Meanwhile child is going without, and there's no need. Mother has good job and good child support settlement, yet child has lice in hair and filthy, outgrown clothes. We will not give in to ploy, but have to do something! Many people have not believed us about this because they don't want to believe that a mother could be that way, and it's frustrating. Anything at all we can do? Why don't fathers have any financial rights when it comes to their children? Why do they have to simply hand over to Mom? It's not right, esp in a case like this. Please help.

The short answer to your question is "no." You can't change this person. But I don't understand being "goaded" into taking custody of the child. Sounds to me like the child is in trouble. Are you going to try to rescue her - i.e., attempt to get custody - or let her remain where she is? Although money should not be your motivation - and it does not sound like it is - you should note that if your husband becomes the custodial parent, then his ex will be required to pay child support.
