Legal Question in Family Law in Texas
Transfer of Child Custody from one parent to another
I am a divorced parent of two children (under the age of 12) and re-married. My ex-spouse and I were divorced in Texas. My ex-spouse then moved from Texas to Georgia with our children 6 years ago. The children are here visiting me and my current spouse for the summer. I just received a call from my ex-spouse who wants to leave the children with me for an undetermined amount of time. We can't afford an attorney, but I would like to have something to legally protect myself and my children in this voluntary arrangement. Besides this, I also need to know what I need to file to remove the portion of the divorce decree that withholds child support from my income (the ex-spouse has also agreed to this). What do I need to do at this point?

You need to file a document called a MODIFICATION. The cost in Harris County is approximately $36. (Price will vary according to your county).
If everyone is in agreement and will sign, the modification is pretty easy.
You can try to do it yourself but I recommend an attorney.
If you want to try to do it yourself, go to a local law library and look at the books for guidance. Each county and/or court have their own "local rules" and you need to go by the courthouse and get a copy for your use.
