Legal Question in Family Law in Texas

transfer of child custody from one relative to another

I have been given permanent custody of my great nephew. He is now living with his aunt and uncle in Texas and is doing well. Presently, I have given them power of attorney but the aunt is telling me they cannot claim him as a tax deduction unless they have legal custody of him. We all agree the best thing for the child is to be with them but I am non sure what documents I need to complete and how to proceed with a transfer of custody. I also need to know which state I need to deal with first (Georgia or Texas).

Thank you,

DY

Re: transfer of child custody from one relative to another

Custody of the child must be done through the court that granted you custody. Your aunt in TX can ask to have the case transferred to TX or you can originate the case in GA.
