Legal Question in Family Law in Texas

Transfering Child Custody

I would like to reenlist, but to do so I will need to give up custody of my kids for the first year of service. I have 4 kids (I have been married and divorced several times). I have an open case with the Attorney Generals office. The first born (7yrs) has no father of record/ birth certificate. The 4 yr old twin's father is willing to take all 4 kids. I have been unable to reach the younger son's father (1 1/2yrs) as he has expressed no desire to contact or visit his son as of yet. I am wondering which would be better; if it would be best to move to Utah and establish residency (that is where my ex husband currently resides and where the children will go) and then petition for a transfer of child custody or do it here in Texas? What are the best steps I need to take to transfer child custody?

Re: Transfering Child Custody

Be very careful about your choices here, as you may lose more than you realize.

In each case where there is an established parent, there needs to be a petition to modify filed. If there are orders out of Texas courts, it would be easier to handle it through the Texas courts. It is not likely that you will be able to do this without a lawyer.
