How would I go about transferring guardianship of my 1yr old to my father?

Based on your zip code, you don't live in Harris County. I only practice law in Harris County.

My first suggestion is to avoid the word GUARDIANSHIP. In Texas, you don't want a guardianship. It is expensive and you are totally under a judge's control. I don't think that is what you want for your child.

What I think you are trying to do is give your father LEGAL CUSTODY of your son. That is totally a different legal process than GUARDIANSHIP.

You need a family law attorney in your county.

Unfortunately, it is probably not going to be easy since the bio. father is PRESUMED the next one in line to have legal custody.

If the bio. dad is a "bad dude", then you can get that legal presumption over-come. However, it is not easy.

You need an experienced and excellent family law attorney to assist you in this matter.
