Legal Question in Family Law in Texas

Trespassing?

I know someone that got arrested for trespassing. HOWEVER, she was going to collect child support, was told to come over and get it, and had text messages proving she was told to come over. Her ex's new woman, basically attacked her, scratching and hitting her. An officer was called and happened to be a relative of the new woman. They arrested the person I know without even acknowledging the texts or anything because they said she trespasses or something like that. She has to appear in court, but has the texts proving she was given permission. What else is needed, and if possible, what kind of action can be taken against the officer for such a terrible lapse in judgement on their part for just arresting and not actually finding out what happened?

Re: Trespassing?

Just because child support was involved does not make this a family law question. Your friend needs a criminal attorney.

Re: Trespassing?

Ms. Bushman is correct, this is a criminal law question, and that she needs a criminal defense attorney. It is unlikely that the ADA is going to give your friend much interest in her evidence. Those text messages are valuable, and she needs to make sure she protects them. She needs a criminal defense attorney to handle this.
