Legal Question in Family Law in Texas

TRO w/petition of divorce

I was served w/ a Petition for Divorce and a Temporary Restraining Order by my husband. The Temporary restraining order was stamped ''This Temporary Restraining Order is Mutual as to Both Parties''. Does this mean he can not do any of the things stated on the TRO also? One part of the TRO states '' Consuming alcohol within the 12 hours before or during the period of possession of or access to the children'', and I have proof that he was at a bar drinking with my son there before I picked him up. I actually had to meet him at the bar to pick up my son. What can I do about this?

Get a good family law attorney. He or she will know what to do. A contested divorce with children is not something to try to handle yourself!

A mutual TRO does mean that the prohibited conduct does relate to both you and your husband. If you are able to prove at the hearing that he has violatred the TRO, then that will be a positive for you. I am a board certified specialist in the field of family law and practice in the general Houston area. I can assist you with this matter and it is definitely something that you are needing to get an attorney to reeresent you.
