Legal Question in Family Law in Texas

I ive in TX and have 3 year old. She has my last name.Her father was court ordered 2 1/2 years ago to get his name on BC after DNA testing.He never did.She soon will be starting school. Her bio father is consistently confusing her to the point she doesnt know wht her last name is now.Is there anything I can do legally for him to be ordered to stop calling her by a wrong name, or is ths really considered petty?The reason I ask is she now gets angry when i ask her her name and says "I dont know" and she herself has asked me to ask him to stop but he absolutely wont .And does he have access to her in school w/o the BC?
