Legal Question in Family Law in Texas

unknowingly divorced

married in 1997. In Jan of 05 husband filed for divorce. I signed what i though was a waiver saying i was not going to get my on attorney and divorce would be handled by husband. we reconciled. stayed in home. in Aug 06 we separated. In Apr 07 i filed for divorce, found out a divorce was granted in Sep 05. i was unaware. never notified. is it possible. i received nothing in ''divorce'' accept child support for two children. husband kept home, vehicles, retirement (military), business income, investment properties, stocks. do i have any recourse. divorce was granted in Sep 05, i did not move out until Aug 06. i finally obtained a copy of decree today. how can this happen without my signature or me not being aware.

Re: unknowingly divorced

You apparently signed a waiver which waived the need to notify you of the proceedings. The waiver is in the court's file. Find out what you signed. You MIGHT have recourse, but you probably don't. You may be able to make a good case for being married since the date of the divorce. Do yourself a huge favor, and go hire a lawyer today.
