Legal Question in Family Law in Texas

Unknown Father Adoption

I recently got married. My husband wants to adopt my son from a previous marriage. When I divorced three years ago I had a parteninty test done, proving my ex was not the father. My EX named another man who I had not known I had sex with that night (I had not known I had sex with either of them) we had the second man tested and it came back negative also. They did not name anyone else who had sex with me that night. SO where do I go from there. In Texas Ihave to have the father's permission for the adoption to go through, but I have no idea who the father is. Can someone please explain how they go about trying to identify the father. I have no desire to find him, except for the signature I need for the adoption.

Weston Cotton still practices in Baytown to my recollection. There are quite a few fine lawyers in that city who could help you.

Re: Unknown Father Adoption

You have to terminate the biological fathers rights before an adoption can take place. There are ways to terminate the biological fathers rights without knowing who he is. You will need to contact a lawyer in your area in order to complete this process.

Good Luck!

Re: Unknown Father Adoption

Despite the fact that the father is unknown, termination of his paternal rights can be accomplished rather easily through the established process.

I suggest that you contact an attorney in your area to advise you further.

Best of luck.
