Legal Question in Family Law in Texas

Unmarred custody

My son and I moved to out of state. His father and I never lived together and never had a dating relationship. He wanted to move with us then changed his mind at the last min. Now he says I m keeping him from his son and is threatning to have me arrested for kidnapping and take my son away from me. I want to ensure this doesnt happen. What are my rights?

You have the right to retain an attorney to assist you in this problem. The fact that you never lived together nor had a dating relationship is not conclusive of your exclusive right to his son. You need a court order to resolve this situation. What if he goes to court first and convinces a judge to require you to return his son to his custody? Can that happen? You betcha. Can he do that? Yes he can: all it takes is money. Will he do that? You know him better than I do. Better get busy. Good Luck.

Based on the limited facts you gave, I don't think he can have you arrested for kidnapping.

If you have court orders (signed by a Judge) then you must follow them.

If there are no court orders, then you are not ordered to do anything.

You really need to talk to an attorney.
