Unmarried and No Proof of Child Support

I have a 6 year old son with a man that I have had an ''off an on/bad'' relationship with for almost 25 years. We never married. During the past 6 years we have broken up 3 times.I am dating someone, and for the 3rd time the father is slandering my name in town and threatening to fight me for custody. He has our son almost 50% of the time now. I am a teacher of almost 20 years, I clean houses for extra money, I dont do drugs, never been in jail, I provide a nice/clean home, pay my bills on time, I'm a fairly normal single mother. The father on the other hand has had to have professional counceling twice (because he couldnt handle me having a boyfriend around his son), he has been in jail for drinking at least twice, he does have a good job, but he has never paid regular ''child support''. He gives me money now and then, usually cash, he paid for day care for a couple of years, and he carries our son on his insurance. This man can not even prove that he has given me more than probably $500 over the past 6 years but he feels he should get custody because my boyfriend spends the night with me in my home. What are his rights? Would a judge make him pay back child support? What are his chances of getting custody with his history?

Assuming that this is the complete story -- then you are very unlikely to lose custody. He would probably get standard visitation, paternity needs to be established, he has to pay back support for four years, and has to pay current support. He might be able to get a clause in the order that no one can have an unrelated guest spending the night in the home. You also can get an injunction to stop him from harrassing you.

Get a lawyer to get this resolved before it gets worse.
