Legal Question in Family Law in Texas

unpaid child support

hi . i have not recieved child support from my ex husband since dec. 2006. i have a court order for him to pay monthly through texas attrny general. i understand that the A.G. office is helping at no charge. i have been keeping them updated on his whereabouuts and pushing for court date . i have been told that he has recieved enough deliquent notices and court date would be set after april 8th. made call to a.g.'s office and as always i get a different answer about whats going to happen next. no court date. i am tired of him getting away with not financially helping with his children and ready to retain an attorney to make changes. i need some questions answered before i spend money i dont have to make changes. he has been in a rehab for 4 mos in odessa tx. a.g. will not help track him even with info to contact him. i would like to know if i have representation could i make an offer to him. the offer would be i drop child support case if he agrees to sign over all rights to me and no contact unless it is by childrens choice. there are reasons for this and would provide if asked. if this is not an option i would like the monthly amount changed. 435. a month for 2 kids. he carries no insurance on them . thanks for your time.

Re: unpaid child support

Really sorry for your situation. All to familiar story. I doubt that a judge would allow legal effect to your offer. Could be that some miracle could occur next year and your X could pay all delinquent child support. Not sure how the AG takes cases to trial - might be their evaluation on ability to recover. That's how they keep score - on money collected - not taking deadbeats to court to get a judgment. Hang in there.
