Usage of Married Name after Divorce

My husband's ex-wife still uses his last name, they have no children together. She is pregnant out of wedlock and wants to use his last name on her baby with another man. What can we do to legally prevent her from doing this? She lives is TX and we live in GA.

In Texas, if her name is "smith" she can name her child "smith" too.

If she did not change her name at the time of the divorce (or since then) its her name and she can give her child her name.
