Vacation without custody order.

I got a divorce 9 months ago in Illinois the judge didn't order child custody because my son is a resident of Tx. I tried to get an order once when I let my son see his father and he wouldn't allow me to see him. The judge didn't make an order because I filed alone and it wasn't correct, a mediator agreed to help and draw a order. My ex wouldn't sign the papers, so we tried to have a verbal agreement for the holidays, I let our son spend Nov. 17 thru Jan 1 with dad. Dad asked for 1 more month, in Illinois. I agreed and I was to visit on Dec. 28, my ex is now avoiding me. Won't allow me to see our son. Do I need to get an attorney and restart old case or will my son be a resident of Illinois by that time.

Get an attorney and re-start the old case right now if you can. Or start a new case if you can. Can't tell from your question. But it's obvious you're going to need an attorney if you want to see your son. Good Luck.
