valid age for minor to say with who he want to live

my son is 9 y/o the mather have the costody and he want to live with me, at what age he can say with who he want to live?

Under Texas law, a child 12 years of age or older may file what is called a statement of choice of conervatorship with the court as a part of a pending suit affecting the parent-child relationship. Such a statement is not binding on the court, but the court will take it into consideration in determining what is in the best interests of the child. Some judges give the statement of choice more weight than other judges. It all depends. However, as I said, such a statememt is not binding on the court.

12 years old and then the Court will still apply the best interest of the child test.
