Legal Question in Family Law in Texas

Valid Paperwork?

My husband and I moved to Texas last August after the mother of his kids relocated here. She and her new husband of 2 yrs have legal custody of both kids (daughter age 10, and son age 6). Before moving we lived in Arizona and she in Northern California. Because all of the court visitation-paperwork is filed in California, is it still valid in Texas?

Re: Valid Paperwork?

My friend Basil was a bit brief in his reply. Yes, the orders from another state are indeed valid. You may have difficulty trying to get the police to back you up, in the event that they are not complied with. If you want to enforce the orders in court you must register the order in Texas, or have a modification of the orders you must transfer the case to a Texas court in the county where the children have resided for at least 6 months. I suspect that neither of our answers really tells you just what you want to know. Your question was not specific enough for us to really "know" the question. Feel free to call me with the specifics if you want to know what to do next but be advised that transfer of cases from state to state are not cheap or fast. I give free 20 minute consultations and do not accept collect calls.

Good luck.

There are procedures for registration of foreign (California) custody papers if you need to try to enforce them.
