Verbal agreement to pay child support

My husband and his child's mother, they were never married, had a court order for her not to pay child support. In 2006 they verbally agreed that she pay $200 a month, school supplies, and $300 at the beginning of the school year for school clothes. She is now behind in this by $762. When we have the court order modified, can we include the amount she is behind as additional support? She is refusing to pay anything until we get the court order modified.

You need a good family law attorney to help you with the modification, but don't expect anything on the verbal agreement. Only court orders are enforceable.
