Legal Question in Family Law in Texas

My ex is violent, non-supportive and here on a marriage greencard. We are legally married. We share a young daughter. She is 7. He is violent, breaks things and screams even in front of my daughter. I have called police before but he was never charged with violence. Twenty or so years ago he killed someone in his country and served prison time. I did not know this until after we were married. We lost our home to foreclosure due to him not contributing finally at all. My daughter and i moved into my parents house a few months ago. CPS has a record of visiting our family and concerns with my daughter due to his violence. They closed the case sometime ago. We live in the same city, I take her over on the weekends to see him. I stay. He now wants to see her alone and I said no. He pays no child support, I know this is not a reason normally but he is violent and unstable mentally. How do I protect my daughter from being alone with him. I am afraid of filing a protective order because it will enrage him and a pieace of paper wont stop him from killimg us. Please help!

Is there a court order in place now?

Second question: Why are you staying married to this man?

File for divorce NOW. In connection with the divorce, ask for a protective order.

By the way, if you're convinced that a protective order won't stop him from "killing us," then neither will anything else. How much longer are you going to let this man run your life? Find a good local gun store and buy a revolver - .38 Special should do it. Keep it loaded. Keep your doors locked.
