Visitation

I had a baby on january 31, 2007 and the dad and i arent married. he did sign the aop and the birth certificate at the hospital. we were together about a month after the baby was born, and he was going through a divorce, but he decided he wanted to be with his wife. does he have the legal right to take my baby for visitation, and over night stays? and can i ask for my baby not to go over to his wife or soon to be ex wifes house because i dont want her to be in that enviroment? the babys dad told me that his wife has been on drugs can i use that against him and her? i have no idea about my or his rights and was just wanting to know what to expect.

Dad will likely acquire joint managing conservatorship rights with standard visitation. In time he will have the right to keep the child about every other weekend and 30 to 45 days during the summer, depending on how far away he lives. He will likely also be compelled to pay child support. You can allege whatever dangerous conditions you feel exist at his home during legal proceedings.
