my brother passed away 5 yrs ago leaving behind a 1 yr old baby and a common law wife. ever since then, my sister in law always makes excuses about ''being too busy'' or ''never having time'' I'm really close to the baby and the baby is close to me, she's 5 now. I never get to see her, and wish i see her more often because she has hardly any knowledge of the OTHER FAMILY, the one that comes from her father. i would like to know if this is a possible court case and what is the best way to go about it, i miss her and wish i could simply be a part of her life.

Typically only parents have visitation rights and to a limited extent grand parents. You didn't say you were a grandparent so I don't know. But, you can petition the court by a Suit Affecting the Parent Child Relationship. You will need to *prove* to the Judge that it is in the child's best interest to have visitation with you and the other family. A good family law attorney can help you with this. Good Luck.
