Legal Question in Family Law in Texas
more visitation when he never calls
My daughters father is threatening to take me back to court to get MORE visitations even though he's never called to see my daughter.(we live three hours north of him) His parents always call me to see her, and she spends the night at his parents house as well. His parents reside in the same town as him. His parents are the ones that put him up to this.(he's admitted)
If he's never called to see her the entire year and a half we've lived here...can he REALLY get MORE visitation? He's also only called my daughter 3 times on the phone the entire time we've lived here.
We already have court ordered visitation for him (that he doesnt use). But her grandparents want to see her more than the papers say so.The court papers are for me and my daughters father, not the grandparents.
Please help!

Re: more visitation when he never calls
Threats don't mean too much. A court hearing would establish that he has never exercised, and still does not exercise his standard visitation. It is unlikely that a judge would be impressed with his desire to expand a visitation he does not use. The real issue you present is grandparent visitation. What is your opinion about allowing grandparent visitation. If that is what is truly happening, then the court orders can reflect that situation. Then you make a decision as to what visitation you would like your daughter to have with her grandparents. There are several methods of achieving satisfactory results in your situation. If you wish you can email me, and we can discuss further. TCL
