Legal Question in Family Law in Texas

Visitation Concern

My child's father lives in El Paso, TX., but also owns a house in Mexico. It's a real concern that he may take my child to Mexico and not return her to me.

Is there a way to keep him from being able to take her out of the US?

I've seen where children are missing in cases like this and I want to protect my child.

Re: Visitation Concern

It's a real problem.

A client's husband went to Tijuana and took the kids to Mexico for a few hours. No one checked anyone's passports. They just walked over the bridge.

I don't know how to stop someone from leaving the US if no one stops them to ask for ID.

Cruise ships are very strict and I know from personal experience that for a minor child to get on a cruise ship they want a notarized statement from the non-cruising parent that is permissible to allow the child on the ship.

Call your congressman. I don't know how to get the border patrol to stop people and confirm that they are allowed to take their children outside of the US.

If your child does not have a passport, order one for him/her. Then you keep it. The other parent cannot then order a second passport.

If you find out that the other parent has already ordered a passport, you won't be able to get one for the child. Then you can go to court and ask the Court to order the other parent to surrender the passport.

Be sure to teach your children about 1-800 call collect and your phone number! Then never change your phone numbers.
