Legal Question in Family Law in Texas

visitation

the father is coming this weekend and is asking me if he can have him for the afternoon. we are currently waiting to go to court to establish, visitations, child support, etc etc. what do i do? does he have the right to take him? what do i tell him without me looking like i dont let him see him. i just want to be cautios

If you do not have concerns about him hurting or absconding with the child, then I would advise my client to allow the visitation. At this point you are not obligated, however, the court prefers ongoing contact with both parents and your conduct in this regard will be considered.

If you DO have concerns about his behavior, then suggest a visit that is monitored -- ie at a grandparents home or similar supervised environment.

If none exists, and you can substantiate your concerns, then you are within your rights (and duties as a parent) to protect your child and withhold visitation until safeguards are in place.

You should be represented by an attorney.
