Legal Question in Family Law in Texas

visitation

I have a friend who has a 4 year old son his grandparents live in texas and have a temporary order granting grandparent access. how can my friend block the order and not be in contempt of court for not allowing him to fly to texas for the summer?

I don't usually respond to questions from friends of the parties but I'll assume you are just trying to help. There needs to be more information. Were the parents married? Did they get a divorce in Texas? Was the child in Texas when this order was made? How long has the child been in California? My guess would be that the Texas court can't inforce this order but I would move the custody case here or open a case here and ask the court to modify the order. The test is whether it is in the child's best interest. I would urge your friend to work this out amicably with the grandparents. It sounds as if they are interested in this child and are not bad guys. If you file a motion in California court you will get mediation. The time should be spent discussing how to make the continued contact with the grandparents work best for this child.
