Legal Question in Family Law in Texas

Visitation rights

My husband and I raised our Grandson for nearly 5 years. Long story short-his dad was in prison-mom(our daughter) was not able to care for him. Now the dad came and took the child and they are in the middle of an ugly divorce. What do we file to get OUR share of visitation and be kept in the loop? I know about the SAPCR but is that what we would file? and please don't tell me there are NO grandparents rights-I know there are none officially but we have been given consideration here in Texas-not out of the question. Thank you.

I don't know when the dad "took" the child, but if it is very recently, you should file the SAPCR alleging that your custody is in the best interest of the child. Just because it's fair in your mind doesn't make it easy in the courthouse. Good Luck.

You can file a request in the divorce case to be granted "access" to the child. If both parents are unfit as parents, you can ask the court to give you custody of the child.

Custody disputes require expertise to handle properly - I suggest you hire a lawyer.

Find an experienced family law attorney who handles custody/possession for non-parents IMMEDIATELY! Time is your enemy. This is not something you can handle yourself. Good luck!
