Visitation rights

X has midweek overnights and extended weekends - new agreement. Divorced for 9+ years teenage child is unhappy with new arrangement. What rights does child have? Previous was standard midweek dinner and weekends til 6:00 P.M.

Until the child reaches the age of majority, he or she is subject to orders of the court concerning conservatorship. You could file a motion to modify and file a motion with the court to confer with the child so that the court may talk to her about her preferences concerning conservatorship. However, to prevail on the motion to modify, you must show a material and substantial change in circumstances which affect the health and welfare and/or safety of the child. This is a substantial burden of proof to carry. And if the current modification is new, it is unlikely that the court will be willing to re-examine the issue again so soon without some compelling reason to do so.
