My ex has voluntarily allowed my kids 17, 15, 12, and 9 to come live with me because she remarried. My 19 yr old also live with me. She moved with me as soon as she turned 18. My ex lives 75 miles away and makes very little effort to see the kids. Other than Spring break week, she has seen them 3 times in 3 months for about 4 hours at a time. I am still court ordered to pay her $1200/mo child support. She is reimbursing me the $1200 by personal check but is getting later and later in sending it. I have asked her but she refuses to pay any child support or health insurance.She does not work but has a teaching degree and assets. What are my chances of getting a modification to make me the primary, eliminate my child support obligation to her, and enforce child support on her?

Find a lawyer in your area and ask him to file a Motion to Modify NOW. Every month that ticks by is a month that you CAN'T ask the court to order her to pay child support (the court can only "go back" as far as the date you filed your motion).
