Legal Question in Family Law in Texas

Voluntary termination of parental rights

If my husband signs a consent form to allow me to voluntarily terminate my parental rights and responsiblities towards our children will I still have to pay child support and will it be accepted by a judge?

Re: Voluntary termination of parental rights

Will your voluntary termination be accepted?

If there is not another person (step-mom) to step into your shoes, then the Judge might not terminate your parental rights.

I've had judges refuse to terminate when a parent is in prison for life. Their reasoning is that they might inherit money one day or win the lottery and then they would have money to support their children.

Are you fully aware of what it means to terminte your parental rights? You are treated as if you are dead - your children will have NO contact with you. You have no rights to contact or talk to your children. After they turn 18, they may contact you if they wish.

Parental rights are strongly protected. You are entitled to a free attorney in a lawsuit to terminate your parental rights.

Child support in the future will end since you will no longer be a child's parent. However, past-due child support will survive.
