Legal Question in Family Law in Texas
Waiver of Citation
I filed for divorce on May 12 in Brazoria County. I sent my wifea Waiver of Citation at the address I had for her. She received it and returned it to me with the following problems.
1. The address she put on it is not the same as the one on the pitition.
2 She printed her name instead og signing it however it is still noterized.
The address is literally right across the street from where the old address was. They are members of the same family as the man she was living with.
I need to know if this will effect the me being able to get the divorce and also, if this is still good. Should I change the Final Decree to represent the address she used on the waiver.
Secondly. There is a section on the Decree that addresses Income Taxes. We have been seperated for 8 years and each doing our own tax work. Is the section required by law to be on the Decree or can I delete it?
Thank You.

Re: Waiver of Citation
You do not need to change the address. A printed signature is acceptable, since that is how she signs her name, and the notary verified it. Income tax info is not required in a decree, as it is governed by tax regs when the decree is silent.
