Waiver of Service

The Waiver of Service asks me to provide my telephone number, SSN, and Driver's License number. They have my mailing address, is all this necessary in a change of name suit? Part two: Courts have not ruled that I am the father, and the child has someone else's name, so why do they need me to approve the name change, just because I am the alleged or probable father? Am I setting myself up for more legal troubles?

That depends on what the petition is asking for -- is it only a petition for a minor name change? Are you agreeable with the name change? Does the waiver require the parties to notify you of any court proceedings or hearings?

If the waiver is not too general, and if you are agreeable, then it is fine to sign. You need tohave have an attorney briefly review it, to make sure that the other party cannot amend pleadings and schedule hearings without notifying you.

If you sign the waiver, it is possible that you will declared to be the father and ordered to pay child support.

I strongly urge you to hire an attorney to protect yourself.

Don't try to save money by not hiring an attorney. It could cost you a LOT once the court has signed the final pleading.
