Legal Question in Family Law in Texas

Weekend visitation

If a person has visitation on the 1st, 3rd, and 5th weekends of a month, what dates will that person have custody this December? There is a disagreement about this.

Re: Weekend visitation

December - a family law attorney's least favorite month because of all the fighting!

Quick answer - Read the Final Decree of Divorce.

It should clearly state the dates you get the child.

It probably gives you some time at Christmas in addition to your usual visits.

I bet your decree states the 1st, 3rd and 5th FRIDAYS beginning at 6 pm. If it does -- then you have the child December 7 and December 21st week-ends.

If you decree is not specific, then you need to modify it.

Merry Christmas!
