Legal Question in Family Law in Texas

Weekend visits

My girls live in VA with their mother.

According to the court papers. I have

a choice of every other weekend or

one weekend of my choosing. I have

been using the every other weekend.

My parents have been getting the

girls. They have a three day weekend

in October 10th-13th. I wanted to

switch weekends with their mom but

she said no. Can I opt to not do the

every other week ends on months

like this. So i can spend some time

with them. I would like to fly them

home at least once a month but the

regular weekends would only give me

one day with them. I hate that every

thing has to be such a hassle. But

their Mom will not speak to me

without screaming and I'm not going

to fight with her. Please help!

Re: Weekend visits

In order to answer your question, I would have to see the decree, and the specific language. It might be necessary to get a clarifying order. The language of the decree should guide you -- how are you supposed to make the choice? Are you required to notify her in writing? Have you? If you have followed all of the necessary steps, then your choice is to file a petition to enforce the decree.
