Legal Question in Family Law in Texas

Widow seeking husband's retirement

My husband passed away and my name was not on the policy at all. His ex-wife's name is on the policy along with an alternate. My question is am will I be able to collect my husband's retirement even though my name was not on the policy. His ex-wife is not entitled, because she gave up her rights when they divorced.

Re: Widow seeking husband's retirement

In each case the beneficiary of the proceeds of either life insurance or a retirement plan is governed by the designation of beneficiary form filled out initially.

If you were excluded from one or more of these, check with a lawyer to see if your community property rights were violated.
