Legal Question in Family Law in Texas
My wife and I have been divorced for one year. We have standard joint custody with me being the non custodial. (Texas)
During my time with my son last weekend my son was going to run to me while I wasn't watching and was knocked down by a passing golf-cart and received scrapes and bruises from the gravel.
My x wife immediately went through the roof with accusations of poor parenting, drinking, etc.
Informed me she would be calling the state to report, and ask for supervised visits
This is a very isolated case with no other incidents like this. What will most likely happen here?
1 Answer from Attorneys
I assume she intends to call CPS. They may or may not investigate. Hopefully you have the names and phone numbers of witnesses to the event.
She might also contact an attorney regarding modifying your current custody arrangements.
I suggest that you contact the attorney that handled your divorce.
Obviously the two of you do not communicate effectively. Accidents happen.
FYI: If you want to eliminate future problems, don't drink when you have your child. (Even one or two beers when it's hot and playing golf can impact your reasoning.) If you want to eliminate her ability to bring this issue up in the future, then just don't drink around your kid. Then it won't be an issue again. And, yes judges will order you NOT to drink around your kid!
