Legal Question in Family Law in Texas

My wife, her mother is in poor health, has alzheimers and is being cared for at her sister's home along with another sister. There are five sister's all together, two are out of state three here in San Antonio, TX. The sisters had a falling out but now the two sisters who are caring for the mother tell my wife and other sisters "They are not welcome in their house to visit there mother". My wife loves and cares for her mother deeply and is saddened by the falling out. The other sisters are determined not to let her or the other two sister into their home to visit their mother. What can my wife do? Is there something she can ask a court or agency to do or intervine in order for her to be allowed entry to see her ailing mother? Please advise.

These are almost always sad cases. I usually recommend that family members try to mediate their disputes in these cases before getting into what could become very expensive litigation.

If that does not work, then you could ask a court to appoint a guardian. Beware, you might end up with your wife's sister being the guardian. It is possible, though, that the court could refuse to appoint someone who is keeping the mother from her family. In most of these cases, there are lots of accusations flying around and it is hard to predict what the court will do.

An attorney who practices guardianship law should be able to help you sort this out.
