Legal Question in Family Law in Texas

Ex wife is putting son's life at risk !!

Been divorced 9 yrs, ex has custody of my 12yr old son. He aksed to live w/me for the past 2 yrs.She flat out refuses. He has eating disorder(eats to ease stress),has developed medical issue because of disorder, attempted suicide 5 mnths ago because of disfunctional situation in her home. Reported this to CPS twice in the past yr. They removed him from the home temporarily but she took him back. Tried to go thru court, but her lawyer was tough. Now son is drawing violent drawings, eating himself sick, having trouble at school. Ex is ordered to take him to counseling but doesn't participate...leaves him there and goes shopping while he is in his session. Counselor states ex has no concerns for my son. My son is withdrawing, showing signs of aggression at school. School counselor reported to my ex that my son was having emotional breakdowns at school. Ex never told me or the counselor about my son's issues because she tells everyone he is fine, happy and glad to be with her.

I have little money, spent about $7000 last year in court and only got joint custody. I want my son happy and safe. What can I do? How do I prove she is unfit and he needs to be with me?

The fundamental answer is keep trying. Sounds like the counselor would make a good witness. Maybe also your son. I recognize it's expensive, but ask around for an attorney who can beat your wife's "tough" attorney.

I agree with Mr. Grissom. Additionally, if your son has a good therapist, schedule some appointments for the times you have possession, and meet with the therapist and share your concerns. If you have joint custody get involved at his school, with his counselor, etc. You have the ability to make an influence on him. Also there are lawyers who take payments plans that are very good. Talk to the people at the law school in your town. They often have referrals and clinics that are supervised by the most qualified attorneys.
