Legal Question in Family Law in Texas

Me and my wife seperated just a few weeks ago and have mutually decided it is over and are getting a divorce. Do I have to split my tax refund with her? She took all the furniture but my bed and I am still paying her bills. If not do I have to file for my return with her or how do I file. She has not worked this year and I have been the one supporting her and our 2 kids.

If you file a joint tax return for 2010, the refund check will be payable to both of you, and both of you will have to endorse it to cash it.

If you file "married filing separately," you will get a refund check payable to you only.
