Legal Question in Family Law in Texas

my wife is working and i am not. she thinks i am cheating on her because i'm always home. her fears are unfounded. i just can't find a job in my field right now, which is auto body repair. she's throwing me out of the house because i can't find a job. everyday, after i drop off our son at school i look for employment. but no one is hiring right now. i also have to pick up our son from school. which i don't mind because he's my son. she feels she has no option but to throw me out based on her fears.i've asked for a divorce, but she refuses, stating it will cost her too much money. she is a registered nurse. can she legally throw me out?

No. But if she's determined for you to leave, you have to worry about her conjuring up some story about abuse and calling the police. Then you'll have a whale of a problem on your hands.

If the fear of an affair is REALLY the issue, ask her what you have to do to gain her trust back. For example, if you can't find a job, you sure can find some volunteer activities. Sometimes those connections can lead to employment.

If she's just tired of you not earning any money, then you need to find any kind of job you can even if you have to flip burgers for a while.

Otherwise, file for divorce, ask for spousal support (!), and get ready to pay child support.
