Wife of 14 yrs walked out 3 weeks ago and filed for divorce I want to know if she can take the kids and house when we go to court I live in texas

You need to hire a family law attorney immediately.

I practice in Harris County. From your zip code I cannot tell what county that you live in. But most judges want both parents to be involved in their children's lives. They want the parents to "co-parent" their children.

Look on this website and on www.avvo.com and hire an attorney. Look around...many attorneys will offer a free consultation either over the phone or in person. Most offer payment plans.

I do not work with her so I don't know how much she charges. Tell the person that answers her phone that I told you to call her. She represented my male cousin and she got him legal custody of his kids in a very nasty and long custody battle. She is a tough, smart attorney.

In Texas, it is presumed that you will have joint custody of the children -- unless there is a reason that she can prove that you should not have joint custody. There are rights and duties that the parents share and you need an attorney to explain these rights and duties to you. You need to get as many of these as possible. She won't want to give you a lot but you can "fight" and usually get a lot of them.

Mediation is usually an option for divorcing couples. It is usually less expensive than litigation. So talk to your attorney about using it.

Judges like fathers that want to stay involved in their children's lives. So don't let her take the children and move far away so that you cannot see them easily.
