Legal Question in Family Law in Texas

No will, living spouse, older siblings and minor sibling

My mother just passed away and did not leave a will. My step-father is the beneficiary on her life insurance policy. My brother and I have paid for most of the funeral expenses and other expenses of our younger sibling, which is a child of my step-father. My younger sibling is living with me right now and I would like to be her guardian. My step father is not very good with finances and I want my younger sibling to be taken care of. There are medical bills that are still outstanding, which need to be paid. Will myself, brother and younger sibling be entitled to any of the money from the life insurance policy, even though we are not beneficiaries.

No. Life insurance is distributed to the named beneficiary. Any other property is subject to distribution according to the Texas Probate Code. If this is important to you, I suggest you see a lawyer soon.
