Will or Marriage?

I recently married a man who was widowed 5 years ago. His first wife and he had wills made up in 1988 leaving everything to their daughter. Do I as his wife have any legal basis for any of his property?

He can pass all of his property by will. Any community property that you may accumulate in the marriage is always 1/2 yours. As a surviving spouse you are entitled to a life estate in any homestead subject to payment of taxes, fees, etc.
