Legal Question in Family Law in Texas

Will I pay Child Support after my husband is dead?

My husband divorced his previous wife in Texas. The decree contains an order for child support and the following paragraph: It is further ordered and decreed that the provisions for child support in this Decree shall be an obligation of the estate of Petitioner and shall not terminate on the death of Petitioner.'' Does this mean that I as the inheritor of the estate will be required to pay child support should my husband die? We now live in Utah and my husband's ex now lives in Arizona.

Generally, it also means that the minor child will receive some social securityif she qualifies if her dad dies.

I agree with Mr. Lundren. This is an obligation of his estate. You only inherit what is left over.

Without reading the terms of the order, and any estate documents, it cannot be determined totally. However, it appears that any remaining child support obligation will be reserved in the estate and you will not inherit that money, only the excess not needed for support.
